Terms of Service

The terms on which you use the website, game servers, bots and other CYBERSPORT.KG services. Written in plain language; if anything is unclear, write to us and we will answer.

1.General

These Terms of Service (the “Terms”) govern the relationship between the CYBERSPORT.KG project (the “Platform”, “we”, “us”) and anyone who uses the Services (“user”, “you”).

“Services” means the website cybersport.kg and its subdomains, the Counter-Strike 2 game servers operated by the Platform (matchmaking, lobbies, tournaments, arenas, practice servers), the Platform’s Telegram and Discord bots, the Platform’s public channels and communities, and related software and tools.

These Terms apply together with the following documents, which form an integral part of them:

  • the Privacy Policy, describing how we handle personal data;
  • the Platform Rules, covering conduct, fair play and sanctions;
  • the rules of a specific tournament published on its page, for the duration of that tournament.

Where documents conflict, the more specific one applies: tournament rules prevail over the Platform Rules, and the Platform Rules prevail over the general provisions of these Terms. On personal data matters, the Privacy Policy prevails.

By starting to use the Services — signing in with Steam, connecting to a game server, adding the bot or sending it a command — you confirm that you have read and accept these Terms. If you do not agree, do not use the Services.

2.Age and capacity

You must be at least 14 years old to use the Services. If you are under 18 (or under the age of majority in your country), you may use the Services only with the consent of a parent or legal guardian, who is responsible for your compliance with these Terms.

If you live in the European Union or the European Economic Area and are below the age at which the law of your country allows you to consent to online services on your own (between 13 and 16), you may use the Services only with parental consent.

A minor may pay tournament entry fees and receive cash prizes only with the consent of a parent or legal guardian, which must be confirmed at our request. A prize won by a minor may be paid to their legal guardian.

When using the Discord bot you must also meet Discord’s age requirements, and when using Steam — Steam’s requirements.

If we learn that a person below the required age is using the Services without parental consent, we may restrict access and delete the associated data.

3.Account

An account is created the first time you sign in with Steam. You need a valid Steam account that you own. We never receive or store your Steam password: authentication happens on Steam’s side via OpenID.

One person, one account. Transferring, selling or sharing an account, playing on someone else’s behalf, boosting, and creating additional accounts to manipulate ratings or evade sanctions are prohibited and lead to a ban of all linked accounts.

You are responsible for activity on your account and for the security of your Steam account and linked services. If you suspect your account has been compromised, tell us as soon as possible.

Your nickname, avatar and profile details must not break the law, infringe the rights of others or violate the Platform Rules, and must not impersonate another person, a Platform representative, Valve or Discord. We may change or hide such a nickname or image.

You may stop using the Services at any time and request deletion of your account by writing to info@cybersport.kg. What is deleted and what is retained (for example, results of tournaments played and sanction records) is described in the Privacy Policy.

4.What the Platform provides

The Platform is an amateur and semi-professional Counter-Strike 2 esports community. Among other things, we provide:

  • matchmaking, lobbies and tournaments on our game servers, ratings and seasons;
  • player, team, club and match pages, statistics, match recordings (demos), replays and clips;
  • forum, comments, match chats, team finder and other community features;
  • notifications via the Telegram bot and features of the Discord bot;
  • tools for players (demo analysis, grenade lineups, tournament brackets, etc.).

The core features of the Platform are free. Only participation in certain tournaments may be paid (see “Tournaments, entry fees and prizes”).

The Services are provided “as is”. We keep developing the Platform and may add, change or disable features, perform maintenance, and change the set of servers and modes. We give advance notice of material changes that affect paid participation.

Some modes (for example, rated matches or tournaments) may have additional requirements: a linked Telegram account, use of fair-play protection tools, or no active sanctions. Such requirements are stated on the mode or tournament page.

5.Fair play and conduct

Detailed rules and sanctions are in the Platform Rules. In short, the following is prohibited:

  • using cheats, macros, third-party software or exploits that give an unfair advantage, and bypassing or interfering with fair-play protection tools;
  • match fixing, betting on matches you take part in, and win trading;
  • insults, discrimination, threats, harassment, publishing other people’s personal data (doxxing), spam and fraud;
  • posting illegal content, sexual content, promotion of violence, extremism or terrorism, malicious links or software;
  • disrupting the Services: attacking or overloading servers, automated data collection (scraping) without our written permission, attempting to access other people’s accounts or restricted areas;
  • buying or selling accounts, tournament slots or other Platform features outside the official payment methods.

While using the Platform you must also comply with the Steam Subscriber Agreement, the rules of Counter-Strike 2 and, when using Discord, the Discord Terms of Service and Discord Community Guidelines.

6.Moderation, sanctions and appeals

We moderate the Services to ensure fair play and community safety. Sanctions depend on the severity of the violation: a warning, a matchmaking restriction, hiding or removing content, voiding a result, a temporary or permanent ban of the account and linked accounts, disqualification from a tournament.

Decisions are made by moderators and administrators. Some measures are applied automatically according to predefined rules — for example, a matchmaking restriction for not accepting or leaving a match. Decisions to ban for cheating involve human review.

You can report a violation or illegal content through a ticket on the website, an in-game command, or by email at info@cybersport.kg. Please state where the material is and why you believe it violates the rules. Reports are handled diligently and without undue delay; we inform the reporter of the outcome if they left contact details.

If a sanction is applied to you, you will see its type, duration and grounds in your account or receive a notice, except where disclosing details would hinder the fight against cheating and fraud.

You may appeal a decision within 7 days in the manner set out in the Platform Rules. Where possible, an appeal is reviewed by a person who did not make the original decision. Permanent bans for cheating and ban evasion cannot be appealed unless the Rules state otherwise. Users in the EU retain any other remedies available under law, including going to court.

A ban does not release you from obligations that arose before it. Entry fees for tournaments from which a player or team was disqualified for a violation are not refunded.

7.Tournaments, entry fees and prizes

Tournament terms — format, dates, entry fee, prize pool, participant requirements — are published on the tournament page and in its rules. By registering, the captain confirms that all team members have read and accept these terms.

Entry fees are paid only through the official methods shown on the tournament page: via our payment service partner or to the organiser’s payment details. We do not receive or store your bank card details. An entry fee is a charge for participating in a specific tournament; it is not a bet, wager or purchase of a chance to win, and the outcome of a tournament is determined by the players’ skill.

Refunds:

  • if a tournament is cancelled or rescheduled on our initiative and the new terms do not suit you, or if participation became impossible through no fault of your own — the fee is refunded in full;
  • if you voluntarily withdraw before the tournament starts — the fee is refunded minus the deduction stated on the tournament page, which covers payment processing and organisation costs;
  • after the tournament has started, in case of no-show, or disqualification for a violation — the fee is not refunded.

Refunds are made using the original payment method or another agreed method, usually within 14 days after the grounds for a refund are confirmed. Crediting times depend on the bank or payment service.

If you live in the EU, please note: tournament participation is a leisure service provided on a specific date, so the general 14-day right of withdrawal does not apply to it (Article 16(l) of Directive 2011/83/EU). This does not limit the refund terms above.

Prizes are paid to winners in accordance with the tournament rules, usually to the team captain, after results are checked for rule compliance (up to 14 days). We may withhold or cancel a prize if a violation is confirmed. Taxes on prizes are paid by the recipient under the law of their country, unless the law places this obligation on us.

Tournament sponsors and partners are not parties to these Terms unless expressly stated otherwise.

8.Your content and match recordings

You keep the rights to the content you post on the Platform: messages, comments, images, videos, uploaded demos and other materials. You warrant that you have the rights to it and that it does not violate the law or the rights of third parties.

By posting content, you grant us a free, non-exclusive, worldwide licence to store, reproduce, adapt to the format of the Services and display it within the Services and their promotion — for as long as the content is posted, and for a reasonable period after deletion needed for backups and dispute resolution.

Matches on Platform servers are recorded by the game (demos, CSTV broadcast, match logs). Results, statistics, nicknames and avatars of participants are displayed publicly. By connecting to a Platform server, you agree that:

  • match recordings and statistics are used for ratings, dispute resolution and checks for violations;
  • match recordings and replays may be available for viewing on the website;
  • tournament matches may be broadcast, including by third-party broadcasters with the Platform’s permission;
  • clips and highlight videos with the player’s nickname may be created from match recordings and published on the website and the Platform’s official channels (YouTube, Instagram, Telegram, etc.).

If you do not want your highlights or voice to appear in published clips, write to info@cybersport.kg — we will exclude your account from future publications and consider removing already published material. Tournament broadcasts and match results are not removed.

We may remove or hide any content that violates these Terms, the Rules or the law, or upon a substantiated request from a rights holder.

9.Intellectual property

The CYBERSPORT.KG name, logo, website design, texts, software code, statistical models, artwork and other Platform materials (except user content and third-party materials) belong to the Platform or are used by it lawfully. Using them outside the Services without our written permission is not allowed.

Counter-Strike, Counter-Strike 2, Steam, the Steam logo and related marks are trademarks and/or registered trademarks of Valve Corporation in the U.S. and/or other countries. Discord is a trademark of Discord Inc. FACEIT is a trademark of its respective owner. Counter-Strike 2 game assets (maps, models, item images) belong to Valve Corporation and are used to display game information.

Mentioning third-party trademarks does not imply any affiliation with, sponsorship by or endorsement from their owners.

10.Steam and Valve

CYBERSPORT.KG is an independent project. The Platform is not affiliated with, sponsored, endorsed or supported by Valve Corporation. Valve is not responsible for the Platform or its Services.

Sign-in and some features are provided with the help of Steam: Powered by Steam. Data obtained from Steam (such as public profile information) is provided “as is”, without any warranties from the Platform or Valve, including warranties of accuracy, completeness or availability.

The Services are not intended for, and do not provide, trading, exchanging or valuing Steam items. The Platform does not run gambling, betting or giveaways involving Steam items or money.

We request Steam data only in connection with your actions on the Platform (signing in, linking, updating your profile) and comply with the Steam Web API Terms of Use. If a user breaches Steam’s terms using the Platform, we may take action and notify Valve.

11.Discord bot

The Platform’s Discord bot (the “Bot”) is part of the Services. By adding the Bot to a Discord server, the server administrator confirms that they are authorised to do so and that server members will be able to interact with the Bot within the permissions granted to it.

The Bot requests only the permissions its features need. An administrator may restrict its permissions or remove the Bot from the server at any time; a user may stop using the Bot and unlink their Discord account from their Platform account.

You may not use the Bot for spam, mass messaging, circumventing Discord’s limits, harvesting user data, or in any way that violates the Discord Terms of Service, the Discord Community Guidelines or these Terms.

What data the Bot receives from Discord and how we use it is described in the Privacy Policy. We do not sell data obtained through Discord and do not use it to train artificial intelligence models.

The Bot is an independent application. Discord Inc. is not a party to these Terms, does not sponsor or endorse the Platform, and is not responsible for the Bot. The Bot’s operation depends on Discord’s availability.

12.Third-party services

The Services interact with third-party platforms: Steam, Discord, Telegram, FACEIT, YouTube, Twitch, Instagram, payment services and others. Their use is governed by their own terms and policies. We are not responsible for the availability, content or actions of third-party services, or for websites linked from the Platform.

13.Warranties and liability

We make reasonable efforts to keep the Services stable and the games fair, but we do not guarantee uninterrupted operation, the absence of errors, delays, server or network failures, complete accuracy of statistics and ratings, or the complete absence of rule-breakers. To the extent permitted by law, the Services are provided “as is” and “as available”.

To the extent permitted by law, the Platform is not liable for indirect damages, lost profits, loss of game progress, rating or virtual achievements, or for the actions of other users and third parties. Unless the law provides otherwise, the Platform’s total liability to a user is limited to the amount the user paid to the Platform in the preceding 12 months.

Nothing in these Terms limits liability that cannot be limited by law: for intent and gross negligence, for harm to life and health, or consumer rights granted by mandatory law of the consumer’s country of residence (including EU law).

To the extent permitted by law, you will compensate the Platform for losses and costs arising from third-party claims against it caused by your breach of these Terms or the law.

14.Termination

You may stop using the Services at any time. We may restrict or terminate access to the Services for violations of these Terms, the Rules or the law, at the request of competent authorities, or if the Services are discontinued, in which case we will notify users in advance where possible.

Provisions on intellectual property, liability, dispute resolution and other terms that by their nature should survive termination remain in effect.

15.Changes to these Terms

We may change these Terms, for example when new features are introduced or the law changes. The new version is published on this page with its date. We give at least 14 days’ notice of material changes on the website, via the bot or by other available means, except for changes urgently required by law or security.

If you do not agree with the new version, stop using the Services and, if you wish, request deletion of your account. Continued use after the changes take effect means you accept them.

16.Governing law and disputes

These Terms are governed by the laws of the Kyrgyz Republic. If you are a consumer living in another country, you keep the protection afforded by the mandatory provisions of the law of your country of residence, including EU law.

Before going to court, please write to us at info@cybersport.kg: we resolve most issues within 30 days. If a dispute cannot be settled, it will be heard by the court at the Platform’s location (Bishkek, Kyrgyz Republic), unless the law gives the consumer the right to sue in the courts of their place of residence.

If any provision of these Terms is found invalid, the remaining provisions stay in force. Our failure to act on a breach does not waive our rights.
